1. General

1.1 Our Commitment

The Theodore & Isabella Wearne Charitable Trust Inc (Wearne Trust) is committed to supporting and complying with the Privacy Act 1988 (Cth) (Privacy Act) and Australian Privacy Principles (APP). 

We respect your personal privacy. This Privacy Policy outlines how we collect, manage, deal with and protect your personal information, and explains how you can contact us to access, correct or control your personal information held by us.

1.2 ‘Personal Information’ 

Personal information means “information or an opinion about an identified individual or an individual who is reasonably identified and:

  1. whether the information or opinion is true or not; and
  2. whether the information or opinion is recorded in a material form or not.1

Personal information may include health information and sensitive information. Information that is sensitive information attracts a higher privacy standard under the Privacy Act.2

2 What information do we collect about you?

We collect personal information from a variety of people we work with and may also collect personal information for administrative functions associated with our work. 

The nature of the information we collect depends on the nature of your interaction with us and the purpose for which we are collecting the information. 

Typically, we will collect personal information when:

  1. you become a member of the Wearne Trust;
  2. you become one of our suppliers; 
  3. you are a social worker, advocate or you hold another similar role and you work with us in providing assistance; or 
  4. you apply to us for assistance via a Representative.

2.1 Recipients 

When you apply to us for assistance through the help of a Representative, we will collect information that is necessary for us to assess your eligibility and tailor our assistance to your needs. Some examples of personal information we may collect include:

  1. your name, e-mail, postal address and other contact details; 
  2. information about your financial situation or the financial information of the person you are applying on behalf of (i.e. income, living expenses, assets and liabilities, employer and/or employment details etc.); or
  3. your health information or the health information of the person you are applying on behalf of (i.e. diagnosis, reports regarding your prognosis and symptoms).

2.2 Members, suppliers, social workers and others

When you become a member, supplier, or you are a social worker or advocate or other person who works with us, examples of personal information we may collect include: 

  1. your name, e-mail, postal address and other contact details; 
  2. payment information for supplies and other donations; or
  3. employment details (what organisation/company you work for). 

3 How do we collect your information?

3.1 Recipients

We will primarily collect your personal information through the Representative who makes the application on your behalf via our website. 

If we need to collect sensitive information about a child under 18 years of age who is not living independently, we will obtain the consent of a parent or guardian. 

3.2 Members, suppliers and others

We will generally collect personal information directly from you via email or our website. We may also collect and update your personal information by communicating with you by phone, social media, email or in person.

4 How do we use your information?

All information we collect remains confidential and will be used and managed in accordance with this Privacy Policy and the APP.

We may use your personal information for administrative functions associated with our work. For example, creating reports for our directors meetings and complying with auditing requirements under the Associations Incorporation Act 2015 (WA).

We will not otherwise use or disclose your personal information for any purpose other than:

  1. the purpose for which it was provided or secondary related purposes (such as our administrative functions) in circumstances where you would reasonably expect such use or disclosure;
  2. where you have consented to such disclosure; or
  3. where the APPs authorise the use or disclosure or we are required or authorised under law to do so.

4.1 Recipients

We use your personal information, which may include sensitive information, to assess your eligibility for assistance. 

In some cases to facilitate assistance to Recipients, we may disclose your personal information (excluding sensitive information) to our suppliers or others that work with us in providing you with assistance. 

5 How do we hold and protect your information?

We take the security and confidentiality of your personal information very seriously. We seek to ensure that all personal information we collect is protected from misuse, interference and loss and from unauthorised access, modification or disclosure. 

We use cloud hosted and cloud based software provided by Flinders Financial (ABN 29 069 144 752) to store your personal information. Some of these cloud storage providers may reside overseas. 

5.1 How do you access, change or make a complaint about your information?

You have the right to:

  1. access your personal information that we hold;
  2. inform us of a correction or amendment to your personal information; and
  3. make a complaint about how we are handling your personal information.

5.2 Complaints about privacy 

The Privacy Act gives you the right to complain about our handling of your personal information. 

You may submit a written complaint to the Wearne Trust by email info@wearnetrust.org.au or through our website, www.wearnetrust.org.au and we will acknowledge your complaint as soon as practicable, fully investigate the matters raised and respond in writing, usually within 30 business days.

5.3 Amendments to this Privacy Policy 

We may amend or update this Privacy Policy from time to time at our discretion.
